This is potentially the second time he is getting a ban, isn't it?

The common sense amendment doesn't constitute an SMP ban awaiting trail, as I've been told the server was deleted before and warrant was issued, and while it's ultimately of the courts to decide to the current laws don't cover that and it ultimately isn't something that can lead to a ban since the warrant was issued for a server that didn't exist at the time of request. Third and ultimately u/und_more serves no threat of potential harm in the mean time until trial. It's ultimately up to moderator discretion on if a user is banned awaiting trial. You cannot demand a preemptive ban, you don't have the authority to do that to my knowledge.

OP
I have testimony saying that the server was deleted after the warrant was issued.
I believe undmore may violate TG law, so I ask you to use your power as a moderator to remove him.

1. "Any human being presumed innocent until he is declared culpable if it is judged indispensable to arrest him, any rigor which would not be necessary for the securing of his person must be severely reprimanded by the law." in response to your "testimony"-that must be proven at trial, it's currently just something that's been said. I've seen no evidence of such.
2. und_more has never violated a law on the SMP, nor have they shown behavior that leads me to believe they will. If you can show me evidence that they've said they'll do something I *might* consider it, but as-of-now there's no evidence of that.

"An exception to this is made for bans. If a moderator or council suspects a user may do damage to the community or violate its laws, they can be banned awaiting trial."
2. UndMore has violated the SAFER act and the common sense amendment as defined in the separation of unrelated servers act

1. "An exception to this is made for bans. If a moderator or council suspects a user may do damage to the community or violate its laws, they can be banned awaiting trial." LITERALLY repeats what my original comment said. It is not relevant as I've already said.
2. That's accusatory, users have the right to "being presumed innocent until he is declared culpable", they have **NOT** "violated the SAFER act and the common sense amendment" they "have been accused of violation the SAFER act and the common sense amendment."
3. Even if they *did* violate those laws-which has not been proven at trial, that is not something that signals them having violation a law *on* the SMP nor is it behavior that motions they will. Just because they violated TG laws within non-TG related servers doesn't mean that they are likely to break laws on-SMP or pose a threat. I believe und has actually taken a stance *against* posting porn to the SMP and such. As so I see it very unlikely that they pose a threat.
4. It's still a moderation decision, you currently only hold the role of foreign minister and hold *zero* authority to either request or demand moderation action. Stop acting like you do. You are no longer a moderator.

OP
This is a moral issue: I believe that UndMore has already violated laws and will continue to violate laws.
users are presumed innocent until he is declared culpable but they can be banned if someone with authority suspects they will violate the laws.
You're in the goonerment, you know he violated these laws. He has therefore a tendency to break sub law, because he kept the goonerment active after the separation of unrelated servers amendment passed and distributed porn.
